Homicide Order Description FORUM 1 SCENARIO In September, 2014, John shot Bill in the stomach causing serious injuries. Bill was taken to hospital shortly after the attack where he was operated on and then placed in intensive care. He developed respiratory problems during his treatment in hospital and the medical staff performed a tracheotomy and inserted a tracheostomy tube in Bill’s windpipe to assist his breathing. He subsequently developed infections and it was March before his condition improved. By April. he looked to have made a complete recovery. On 2nd August, however, Bill had trouble breathing once again and his condition rapidly worsened. He died on 10th April. A post-mortem examination showed that Bill was asphyxiated by narrowing of the windpipe that resulted from the tracheotomy. The condition was rarely known to result. John was charged with murder. He argued that he did not cause Bill’s death as it was clear that the gunshot wound had healed. Reply post: The defence argue that John did not cause Bill’s death.
