Continental Airlines vs. United Airlines Case
The defendants, United Airlines Inc (United) and Airline Management Council (AMC) are being sued for using carry-on bag templates to restrict the size of carry-on luggage a passenger can carry on a plane. The plaintiff views this as a serious concern because they use the carry-on baggage policy to gain a competitive advantage over their competitors. They have invested close to $15 million to fit their planes with larger overhead bins to enable their customers enjoy greater flexibility in carry-on luggage. AMC is an association of international and domestic carriers involved with passenger services at Dulles International Airport (Dulles). United is the biggest airline at the airport. It, therefore, jointly carries out passenger services with AMC, which include screening passengers and luggage.
The defendants instituted a restriction on the amount of carry-on luggage a passenger is allowed to have by introducing templates to measure the size of carry-on luggage. If the luggage is found to be larger than the template, the passenger is referred to X-ray screening point where its contents are screened. Ideally, this is a security measure that ensures that nothing harmful is carried aboard the plane. However, the plaintiffs argue that this is a violation of their competitive strategy under no legal precedence. The security of carry-on luggage is a responsibility of an airplane carrier rather than an airport management agency. In this regard, the plaintiff has invested in robust security measures to ensure that the flexibility they offer their passengers on carry-on luggage does not cause any security threats. The defendants' issue is that they have been sued wrongly as all their actions are not in contradiction to the Sherman's Act. They file a motion to dismiss on grounds that none of their actions is in violation of the Sherman's Act that is denied.
